Article 1 — Purpose
Dilaya is a service published and developed by the company Novopattern (“the Publisher”).
The purpose of these terms of use (“the Terms”) is to define the terms and conditions under which the user (“the User”) accesses and uses the Dilaya service, as well as the rights and obligations of the parties in that context. They supplement, without replacing, the Terms of Sale applicable to a subscribing customer.
Article 2 — Access to the service and user account
Access to certain Dilaya features requires the creation of an account. The User undertakes to provide accurate and up-to-date information and to keep their credentials confidential. The User is solely responsible for any action carried out from their account, except in the case of fraudulent use that they have reported without delay.
Certain features rely on third-party accounts or subscriptions belonging to the User (messaging services, social networks, business tools, etc.). The User warrants that they hold the rights necessary to authorise Dilaya to act on their behalf on those accounts within the agreed scope.
Article 3 — Use of the service
The User undertakes to use Dilaya in accordance with its intended purpose and with applicable regulations. In particular, it is prohibited:
- to use the service for unlawful or fraudulent purposes or in a way that infringes the rights of third parties;
- to use the service to send unsolicited communications (spam) or to harass third parties;
- to attempt to circumvent security measures, to extract data on a massive scale, or to disrupt the operation of the service;
- to use the service in a manner that is contrary to public order or public morality.
Any breach may result in the suspension or termination of access, without prejudice to any legal proceedings.
Article 4 — Intellectual property
The Dilaya service, its technology, its interfaces and its content (other than the User's own data) are the exclusive property of the Publisher or its licensors and are protected by intellectual property law. Nothing in these Terms confers on the User any ownership right over the service.
The User retains full ownership of the data and content they provide or generate through their use of the service.
Article 5 — Availability and evolution of the service
The Publisher implements reasonable means to ensure the availability and proper functioning of the service, without guaranteeing continuous, uninterrupted availability. Maintenance operations or unavailability caused by third-party services may occur; the Publisher endeavours to limit their impact and to inform the User where possible.
The Publisher may change the features of the service; substantial changes affecting the User's ordinary use will be communicated to them.
Article 6 — Amendments to the Terms
These Terms may be amended at any time. The applicable version is the one published on the site at the time the service is used. In the event of a substantial amendment, the User will be informed by an appropriate means (email or notification within the service).
Article 7 — Suspension and termination
The Publisher may suspend or terminate access to the service in the event of a breach of these Terms, under the conditions set out in Article 3, or upon termination of the subscription under the conditions of the Terms of Sale.
Article 8 — Governing law
These Terms are governed by French law.
Article 9 — Language
This English version is provided for convenience only. The French version is the legally binding text: in the event of any discrepancy or difference of interpretation between the two, the French version prevails.
